Sweetwater Flea Market
intends to
maintain a clean, attractive market, therefore, the following Rules and
Regulations are intended to benefit each and every dealer. Dealers will be notified of any changes or additions to these
rules.

No variations to the above mentioned hours
will be permitted. please do not expect us to allow you into the market on
any other days other than the ones mentioned above, without management
approval. This is intended to provide additional security for dealers'
merchandise left during the week.
Dealers must sign in and out during set up and
you will be required to stay within your designated area.
Dealers are required to open for sales
promptly at 8:00 am and remain open until closing time (5:00 pm).
No Alcoholic Beverages permitted on
property. This will be strictly enforced. Anyone failing to adhere
to said rule will be asked to leave immediately.
Reservations:
Spaces must be reserved and paid
for at the office prior to setting up. No Refunds. Management
reserves the right to refuse space to any dealer. Rent for the next
weekend must be paid in full at the office by 3:00 pm on Sunday, No Exceptions -
No Excuses. Dealers are required to remove merchandise on Sunday
of the last weekend rented. Space rental is to be done by office personnel
or management only. No subletting permitted.
Reserved spaces are held until 8:30 am at
which time space will be rented to the next dealer in line unless prior
arrangements have been made with management.

Monthly Discounts are given in consideration
for renters, there will be no refunds for inclement weather.
Lien for Unpaid Rent.
Dealer hereby agrees that Sweetwater Flea Market shall have a lien on any of
Dealers merchandise left in the dealer's space for any unpaid rent or other
obligation of the dealer to Sweetwater Flea Market. In order to satisfy
said lien, Dealers hereby authorizes Sweetwater Flea Market to sell Dealers merchandise left
in Dealer's space at public or private sale without any further notice to the
Dealer and apply the proceeds from sale of said merchandise to the expenses of
sale, the Dealer's obligation for rent and excess, if any to the Dealer.
In addition, if the Dealer leaves any
merchandise in the space and does not remove the same within five (5) days after
written notice from Sweetwater Flea Market is entitled to take possession of said
merchandise, sell the same at public or private sale without any notice to the
Dealer and apply the proceeds from such sale to any rent due, all reasonable and
necessary expenses of the sale and excess to the Dealer.
License and Taxes:
Sweetwater Flea Market as required by the State of Tennessee, City of Sweetwater, and
County of McMinn will collect or enforce compliance for the following Business
and Sales Taxes.
State of Tennessee:
Exhibitor is required to display a State of Tennessee Sales Tax Number or Sales
Tax Certificate. Certificates can be purchased through the Office for (1)
One Calendar Month= $5.00; (2) Quarterly=$15.00; (3) Annual= $45.00.
City of Sweetwater:
Business Tax: $1.00 per day per exhibitor or $2.00 per weekend.
County of McMinn:
Business Tax: $1.00 per day per exhibitor or $2.00 per weekend.
Both Business Taxes are Over and Above
Rental Rate:
You may purchase each of these business licenses on an annual basis from the
City and County. It must be for our location only.
Check Policy:
Monthly rental may be paid by
check. Checks can not be be accepted for daily or weekly rental. No
two party checks will be accepted. A $20.00 Fee will be charged on any
returned checks. After one (1) check is returned, rent must be paid in
cash.
Merchandise:
Absolutely no food or drinks are to be sold without prior written consent from
the management. The sale of any alcoholic beverages, or fireworks is
prohibited. Management also reserves the right to restrict the sale,
display, or distribution of any objectionable printed material, photographs,
films, books, etc. Guns and knives sold on the premises must not be
carried throughout the Flea Market without being packaged. No handbills
will be given out on the premises unless express written consent is obtained
from management. Animals are not to be sold in the indoor Flea Market.
Sweetwater Flea Market does not condone the sale of counterfeit
merchandise and is not responsible for any merchandise sold.
Risk of Loss and Insurance:
Sweetwater Flea Market assumes no responsibility for any physical loss or damage
at any time from any cause to the personnel property of any dealer. Dealer
understands that Sweetwater Flea Market is under no obligation t provide insurance to
cover the Dealer for loss from any cause to any of Dealer's personnel
property. Dealer shall be responsible for insuring against loss any of
Dealer's personnel property located in Dealer's space, and further Dealer shall
provide any general liability insurance for personal injury, death, or property
damage in or about the Dealer's space.
Indemnification:
Each Dealer will indemnify and hold Sweetwater Flea Market harmless from any
loss, cost, or expense of any sort or nature, including reasonable attorney fees
and cost, and will indemnify and hold Sweetwater Flea Market harmless for any liability to
any person on account of any damage to persons or property resulting or
occurring by reason of the use and occupancy of a space by a Dealer, or for any
failure of a Dealer to comply in any respect with or to perform any of the
requirements and provisions of operating rules.
Electricity:
Outlets are available for most inside booths. Excessive use of extension
cords will not be permitted any heavy duty cords are required. Dealers
requiring large amounts of electricity will be charged accordingly. Not
hotplates, coffee pots, heaters, televisions, or small appliances will be
permitted without management approval. Each Dealer is restricted to 300
watts. No heater of any type are permitted.
Remodeling:
No remodeling or electrical work is to be done without prior approval by
management. All partitions, walls, counter, lighting, or building
improvements etc., that are attached to the building shall be considered a lease
hold improvement and become the property of Sweetwater Flea Market when the space is
vacated. No holes will be permitted in concrete. Walls not to exceed
8 feet in height.
Dealer Space:
Dealers merchandise is to be sold or displayed within booth space rented.
Trash:
Trash must be disposed of in the big trash containers provided. Boxes must
be broken down, separated from trash, and placed in proper containers.
failure to dispose of trash properly will result in a $15.00 service fee.
The trash barrels are for the customers only. Dealers may dispose of their
small trash such as lunch bags, cups, Kleenex, etc. in the trash barrels, but
absolutely no boxes. |
